1. Scope

1.1 These General Terms and Conditions (GTC) apply to the use of the platform boommate.com, operated by Boommate GmbH, Mustermannstraße 10, 12345 Musterstadt (hereinafter referred to as the "Provider"). The platform facilitates the rental or purchase of housing units.

1.2 By registering and using the platform, users accept these GTC in their current version.

2. Subject of the Contract

2.1 The Provider offers an online platform where landlords and prospective tenants can connect. The Provider does not rent out properties itself and does not act as a legal intermediary.

2.2 Use of the platform is free of charge for prospective tenants. Landlords can access additional paid services.

3. Registration and User Account

3.1 Registration is required to fully use the platform. Users must provide accurate and complete information during registration.

3.2 Each user is obligated to keep their login credentials secure and not share them with third parties. The Provider is not liable for damages resulting from the misuse of login credentials.

3.3 The Provider reserves the right to block or delete user accounts in case of violations of the GTC or evidence of misuse.

4. Scope of Services

4.1 The Provider provides the technical infrastructure for landlords and prospective tenants to connect. However, the Provider does not guarantee the availability, accuracy, or quality of the listed properties.

4.2 The Provider reserves the right to modify, expand, or restrict the platform’s services at any time.

5. Obligations of the Users

5.1 Users agree to use the platform in compliance with these GTC and applicable laws.

5.2 It is prohibited to provide false or misleading information about properties or personal data. In particular, illegal content or content that infringes on the rights of third parties must not be published.

5.3 Landlords must ensure that the information about their properties is truthful and up to date.

6. Fees and Payment Terms

6.1 Use of the platform is free for prospective tenants.

6.2 Certain additional services for landlords may be subject to fees. Prices and payment terms will be specified during the booking process and are binding.

6.3 Payments must be made using the specified payment methods. In case of delayed payments, the Provider reserves the right to restrict access to paid services.

7. Contract Duration and Termination

7.1 The user agreement is concluded for an indefinite period and may be terminated by either party at any time without stating a reason.

7.2 Users can terminate the agreement by deleting their user account on the platform.

8. Liability

8.1 The Provider is not liable for the accuracy, completeness, or timeliness of content and property listings provided by third parties.

8.2 The Provider is not liable for damages resulting from the use of the platform, except in cases of intent or gross negligence.

8.3 The Provider assumes no liability for direct or indirect damages caused by the use or unavailability of the platform.

9. Data Protection

The processing of personal data is carried out in accordance with our Privacy Policy. Users are informed about the scope and purpose of the collection, storage, and processing of their data.

10. Changes to the GTC

The Provider reserves the right to modify these GTC at any time. Changes will be communicated to users in a timely manner and are deemed accepted if the user continues to use the platform after the changes take effect.

11. Final Provisions

11.1 The laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), apply.

11.2 If any provision of these GTC is or becomes invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a legally permissible regulation that most closely reflects the economic intent of the original provision shall apply.
